Clarification on Transport Canada Form 1 (importer’s name)
As Customs brokers have noticed, the community has been scrutinizing resent Canada Customs Notice N-14-008. The Notice underlined the requirement that the importer of record named in boxes 14, 16 and/or 17 on Transport Canada’s Form 1 has to be the same as the importer of record named on the Canada Customs release transaction and B3 coding form.
In case of a non-compliance with the requirement, the shipments would be held by Customs. Therefore, CBSA and Transport Canada came to find a solution, indicated in the following. This notice will be displayed in an internal notice to be distributed to the border crossing entry ports and will also will be indicated in a new Customs Notice to follow.
Notice concerning Importers Listed on Transport Canada’s Appendix F or G.
Canada Customs forms (B3, RMD, PARS) have to indicate the name of the importer. If the importer shown on the CBSA entry docs is not listed on Appendix F or G, however is associated with a company listed on Appendix F or G to ensure compliance with Transport Canada regulations, Canada Customs will clear the shipment under the these conditions:
Appendix F – the name of the associated Appendix F company is shown in the Related Party field of the EDI entry or on the Customs Broker Exemption Lead Sheet.
Appendix G – the name of the associated Appendix G company is shown in the Company Name field of Box 14 of the Vehicle Import Form – Form 1 in addition to the name of the importer listed on the CBSA entry paperwork.
